BOC-3 Forms: What Trucking Companies Need to Know

Client Image

Starting your own trucking company begins with filing official documents. Once your trucking company is operating you regularly need to renew those documents to stay compliant. One of the most important is filing a BOC-3 Form. But what is a BOC-3 form and who needs a BOC-3 filing? We’ve put together common questions and answers. We even include an Apex trusted partner we recommend for your BOC-3 filing needs.

What is a BOC-3 form?

BOC-3 stands for Blanket of Coverage. A Blanket of Coverage form is a required filing needed to get operating authority. What a BOC-3 form does is assign process agents in each state that can accept legal documents on your behalf.

What is the purpose of a BOC-3 filing?

The BOC-3 filing is part of the Federal Motor Carrier Safety Administration (FMCSA)-required process of starting a trucking company and getting active operating authority. Additionally, the BOC-3 filing allows motor carriers to find trusted process agents to receive government papers on their behalf if any legal action against the trucking company.

Who needs a BOC-3 filing?

All interstate motor carriers must file a BOC-3 form. If you haul loads from state to state, you must have an FMCSA-certified process agent in each of the contiguous states. If you are an intrastate motor carrier, meaning you only haul loads in one state, you do not need to file a BOC-3 form.

What are BOC-3 process agents?

BOC-3 process agents are representatives authorized to receive government and legal documents on behalf of motor carriers hauling loads from state to state. When choosing the right process agent service company to represent your trucking company, make sure they are FMCSA-certified or your operating authority may be in jeopardy
